Veteran's Preference

 
 
VETERANS' PREFERENCE
ACCORDANCE WITH RULE 55A-7.013, FLORIDA ADMINISTRATIVE CODE:

Chapter 295, Florida Statutes, sets forth certain requirements for public employers to accord preferences, in appointment, retention, and promotion to certain veterans and spouses of veterans who are Florida residents.  The relevant portions of the law apply to “the state and its political subdivisions”.  Public utilities, state universities, school districts, and special taxing districts are subject to the requirements of Chapter 295.

Veterans Preference only applies to Support Personnel (SP) positions at Florida Gulf Coast University.

Eligible Veteran's Preference War Time Era

  • World War II (December 7th, 1941 to December 31st, 1946)
  • Korean Conflict (June 27th, 1950 to January 31st, 1955)
  • Vietnam Era (February 28th, 1961 to May 7th, 1975)        
  • Persian Gulf War (August 2nd, 1990 to January 2, 1992)             
  • Operation Enduring Freedom (October 7, 2001 to date to be determined)
  • Operation Iraqi Freedom (March 19, 2003 to date to be determined)

Required Veteran’s Preference Documents

Veteran

  • Form DD-214 or military discharge papers (or equivalent certifications from the VA) listing military status, dates of service and discharge type

Disabled Veteran

  • Form DD-214 or military discharge papers (or equivalent certification from the VA) listing military status, dates of service and discharge type
  • Document from the DOD, DVA or the Division of Veterans' Affairs certifying a service-connected disability

Spouse of Disabled Veteran

  • Form DD-214 or military discharge papers (or equivalent certification from the VA) listing military status, dates of service and discharge type
  • Certification from the DVA that the veteran is totally and permanently disabled
  • Evidence of marriage to the veteran and a statement that he/she is still married to him/her when applying for employment
  • Proof that the disabled veteran cannot qualify for employment because of the service-connected disability

Spouse of Veteran Missing in Action, Captured or Forcibly Detained

  • A document from the DVA certifying that the person on active duty is listed as missing in action, captured in the line of duty, or forcibly detained/interned in the line of duty by a foreign government or power
  • Evidence of marriage to the veteran and a statement that he/she is married to the person on active duty when applying for employment

Spouse of Deceased Veteran

  • The unremarried widow or widower of a deceased veteran shall furnish a document from the Department of Defense or the DVA certifying the service-connected death of the veteran
  • Evidence of marriage and a statement that the spouse is not remarried

Changes to Veterans Preference

Effective July 1, 2007 preference eligibility no longer expires upon appointment of the eligible person to a position with the state or any political subdivision in the state. Persons who were previously ineligible for preference because they held or are currently holding a job with a public employer are now eligible to use their veteran's preference again with all employers covered by law.

Persons who were previously ineligible for preference because they did not serve during an eligible wartime period may now be eligible for Veterans Preference if they served during Operation Enduring Freedom (beginning October 7, 2001 - present) or Operation Iraqi Freedom (beginning March 19, 2003 - present).
